Terms of Service

These Terms of Service ("Terms") govern your use of services provided by My Personal Trainer Malta ("MyPT", "we", "us"), including the website at https://myptmalta.com, the MyPT mobile and web applications, and in-person personal training services. By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to create an account. By using MyPT you confirm that you have no medical condition that would make exercise unsafe without medical clearance. If you have any doubt, consult your physician before starting any training programme.

2. Account responsibilities

• Keep your password secret. You are responsible for any activity under your account.
• Provide accurate information when signing up. Repeated false information may lead to account termination.
• One person per account. Sharing an account violates these Terms.
• Tell us promptly if your account is compromised.

3. Subscriptions and billing

3.1 Plans

Current plans are listed on the pricing page. Prices include Malta VAT where applicable.

3.2 Billing cycle

Subscriptions are billed monthly in advance unless otherwise agreed. The first charge happens on the day you start the plan. Subsequent charges happen on the same day each month.

3.3 Cancellation

You can cancel anytime from the in-app billing page. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial months.

3.4 Refunds

We offer a 7-day money-back guarantee on the first month of any new subscription. After that, refunds are handled case-by-case at our discretion. Email info@mypersonaltrainermalta.com with the reason.

3.5 Price changes

If we change prices, existing subscribers keep their current price for at least 12 months from the change. New subscribers pay the current advertised price.

3.6 AI tokens

AI Boost tokens are non-refundable once purchased but never expire. Tokens included with your subscription do reset monthly and do not roll over (with the exception of the auto-refill subscription).

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, threaten, or impersonate other users
• Post content that is illegal, defamatory, hateful, or sexually explicit
• Attempt to access other users' accounts or data
• Reverse-engineer or scrape the Service
• Use the Service to provide commercial coaching to others without our written permission
• Upload malicious code or content

5. Coaching disclaimer

The training and nutrition information in MyPT is for general guidance. It is not medical advice. Always consult your physician before starting a new exercise programme, particularly if you have a chronic condition, are pregnant, or are recovering from surgery or injury. MyPT and its founder are not liable for injuries resulting from following workouts or advice in the Service.

6. AI features

AI-generated content (meal scans, meal plans, recipe images, training insights) is provided "as is". Estimates are approximate. Do not rely on AI macro calculations for medically-sensitive decisions (e.g. insulin dosing for diabetes). The AI output is not medical or nutritional advice.

7. User content

You retain ownership of any content you create in MyPT (photos, posts, voice notes, custom recipes). By posting publicly to Town Square or sharing a community trail, you grant us a limited licence to display that content to other users and to people who follow shareable links. You can delete your content at any time, which revokes the licence going forward.

8. Intellectual property

The MyPT brand, app code, recipe library, trail catalog, and original written content are owned by My Personal Trainer Malta. You may not reproduce, redistribute, or commercialise these without written permission.

9. Service availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance is announced in advance. Emergency maintenance may happen without notice. We are not liable for downtime beyond refunding pro-rata for extended outages.

10. Termination

Either party can terminate at any time. We may terminate your account for repeated violations of these Terms after one written warning. On termination, your data is retained for 90 days then permanently deleted (see the Privacy Policy).

11. Limitation of liability

To the maximum extent permitted by Maltese and EU law, MyPT's liability for any claim is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Governing law

These Terms are governed by the laws of Malta. Disputes that cannot be resolved by negotiation are subject to the exclusive jurisdiction of the Maltese courts. EU consumers retain any non-waivable statutory rights they hold in their country of residence.

13. Changes to these Terms

We may update these Terms occasionally. Material changes will be notified by email and an in-app banner at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
